Welcome to Red Cloak Home ("Company," "we," "our," or "us"). By accessing our website, placing an order, requesting a quote, or purchasing any product from Red Cloak Home, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website or purchase our products.

1. CUSTOM-BUILT PRODUCTS

Red Cloak Home specializes in handcrafted furniture, bars, kitchen islands, retail fixtures, home décor, and other custom wood products. Unless otherwise stated in writing, all products are considered custom-built and made-to-order.

Due to the handcrafted nature of our products:

  • Wood grain, knots, coloration, distressing, reclaimed wood characteristics, and finish variations are natural and expected.
  • No two pieces will be identical.
  • Product photographs are representative examples and may vary from the final product.
  • Dimensions may vary slightly due to the handmade construction process.

These natural variations are not considered defects.

2. QUOTES AND PRICING

All quotations are valid for thirty (30) days unless otherwise stated.

Pricing may change without notice prior to order placement. Once an order is accepted and payment is received, pricing is locked for that order.

We reserve the right to correct pricing, typographical, specification, or listing errors at any time.

3. ORDER ACCEPTANCE

An order is not considered accepted until payment has been received and confirmation has been issued by Red Cloak Home.

We reserve the right to refuse, cancel, or limit any order at our sole discretion.

4. PAYMENT TERMS

Payment is due according to the terms provided at checkout, invoice, or purchase agreement.

Failure to complete required payments may result in production delays, suspension of work, cancellation of the order, or collection efforts.

Customers are responsible for any applicable taxes, duties, customs fees, or governmental charges associated with their purchase.

5. CANCELLATION POLICY

Customers may request cancellation within fourteen (14) calendar days of purchase.

Approved cancellations are subject to a non-refundable cancellation fee equal to thirty-five percent (35%) of the total purchase price.

After the 14-day cancellation period expires, orders cannot be canceled.

6. RETURNS AND REFUNDS

Because our products are custom-built and made specifically for each customer, all sales are final.

Red Cloak Home does not accept returns and does not provide refunds once production has begun.

Customers agree to contact Red Cloak Home regarding any concerns so that we may evaluate the matter and work toward a reasonable resolution.

7. SHIPPING AND DELIVERY

Estimated production and delivery dates are estimates only and are not guaranteed.

Red Cloak Home is not liable for delays caused by:

  • Supply chain interruptions
  • Material shortages
  • Shipping carrier delays
  • Weather events
  • Acts of God
  • Labor shortages
  • Circumstances beyond our reasonable control

Risk of loss transfers to the customer upon delivery by the carrier or upon customer pickup.

Customers must inspect shipments promptly and report shipping damage within forty-eight (48) hours of delivery.

8. CUSTOMER RESPONSIBILITIES

Customers are responsible for:

  • Verifying measurements before ordering
  • Ensuring adequate access for delivery
  • Confirming products will fit through doors, hallways, stairwells, elevators, and other access points
  • Obtaining any required permits or approvals

Red Cloak Home is not responsible for delivery complications resulting from inaccurate measurements or inaccessible delivery locations.

9. PRODUCT CARE

Customers are responsible for proper use, maintenance, cleaning, and care of all products.

Failure to follow reasonable care practices may affect product appearance and longevity.

Normal wear and tear, environmental conditions, misuse, abuse, neglect, accidents, improper maintenance, and unauthorized modifications are not covered by any warranty.

10. INTELLECTUAL PROPERTY

All website content, designs, photographs, logos, product descriptions, graphics, and related materials are the property of Red Cloak Home and may not be copied, reproduced, distributed, or used without written permission.

11. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Red Cloak Home shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from the purchase, use, or inability to use any product.

Our total liability for any claim shall not exceed the amount paid by the customer for the product giving rise to the claim.

12. PAYMENT DISPUTES AND CHARGEBACKS

Custom Order and Chargeback Policy

By placing an order for any custom, personalized, made-to-order, or specially manufactured product, you acknowledge and agree that such products are created specifically to your requested specifications and are not suitable for resale. Accordingly, all custom orders are final and are not eligible for cancellation, return, refund, or exchange once production has begun.

You further agree that you will not initiate a chargeback, payment dispute, or reversal with your credit card company, bank, or payment processor for any custom order except as expressly permitted by applicable law and subject to the conditions set forth herein.

Non-Delivery Claims

No claim for non-delivery, chargeback, or payment dispute based on alleged non-delivery may be initiated until at least six (6) months have elapsed from the original order date. Customers acknowledge that custom products may require extended production and shipping times, and agree to allow the seller a reasonable opportunity to complete and deliver the order before pursuing any dispute or claim.

Defective Goods

For purposes of this policy, "defective goods" means goods that are materially and substantially different from the specifications, design, personalization, size, or product description approved by the customer at the time of purchase. Minor variations in color, grain, texture, distressing, finish, dimensions, or other characteristics inherent in handmade, custom, or natural-material products do not constitute defects.

Customers must notify the seller in writing within fourteen (14) days of delivery and provide photographs or other evidence demonstrating that the product received is materially different from the approved order. The seller shall have the right to repair, replace, or otherwise remedy any confirmed defect before any refund is considered.

Any chargeback or payment dispute initiated in violation of this policy may be deemed a breach of these Terms and Conditions. The customer agrees that the seller may pursue recovery of the disputed amount, together with any applicable fees, collection costs, court costs, attorney's fees, and other expenses permitted by law.

By completing a purchase, you acknowledge that you have read, understood, and agreed to this Custom Order and Chargeback Policy.

If a chargeback or payment dispute is filed contrary to these Terms and Red Cloak Home prevails in recovering funds owed, the customer may be responsible for collection costs, attorney fees, court costs, interest, and other recoverable expenses permitted by applicable law.

Nothing in this section limits any rights provided under applicable consumer protection laws.

13. GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles.

Any legal action arising from these Terms shall be brought in a court of competent jurisdiction located in Pennsylvania.

14. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. MODIFICATIONS

Red Cloak Home reserves the right to modify these Terms at any time. Updated Terms will become effective upon posting to our website.
